STATEMENT OF CLAIM: "Claim of the General Committee of the Order of Railroad Telegraphers, Chicago, Rock Island and Pacific Railway, that Telegrapher E. E. Harper, Chicago Relay office, be paid a call under the call rule of the telegraphers' agreement because of telegrams transmitted from that office January 18, 1940, by assistant Superintendent of Telegraph Kahl whose position is not incorporated in the said agreement."


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parte by the complainant party;


That no hearing thereon has been had and under date of January 15, 1941, the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case. ,




Case dismissed.
