BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES
SOUTHERN PACIFIC LINES IN TEXAS AND LOUISIANA
(TEXAS AND NEW ORLEANS RAILROAD COMPANY)
STATEMENT OF CLAIM: "Claim of the Brotherhood of Railway and Steamship Clerks, Freight Handlers, Express and Station Employes, Southern Pacific Lines in Texas and Louisiana, Texas and New Orleans Railroad Company, that:
"(a) The Carrier violated the Agreement by its failure to bulletin and fill a vacancy as Port Yard Clerk at Corpus Christi, Texas, which became vacant December S, 1939.
"(b) Clerk Lloyd Carver, Jr., be compensated for all wage losses sustained by reason of the Carrier's refusal to comply with the rules of the Agreement.
"(c) All other employes be compensated likewise for all wage losses sustained by reason of Carrier's violation of rules."
That the dispute was certified to the Third Division of the Adjustment Board ex parts by the complainant party;
That no hearing thereon has been held, and under dates of January 11 and January 21, 1941, the parties addressed formal communications to the Secretary of the Third Division withdrawing the case.
