BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES





STATEMENT OF CLAIM: "Claim of the System Committee of the Brotherhood that the Carrier violated Paragraph (c), Rule 1, Schedule for Clerks, by disregarding the essential requirements of the rule in creating a position designated as traveling accountant and assigning thereto an employe who was without special training and had no experience in accounting, or seniority standing in the Accounting Department. Claim is made that position be bulletined in accordance with the seniority rules of the Schedule for Clerks, with the established rate of $150.00 per month converted to a daily basis, and the successful applicant compensated for any monetary loss he may have suffered, retroactive to the effective date of the assignment."

FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party; and


That hearing thereon has been held but not concluded, and under date of January 20, 1941, the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case.



Case dismissed.
