STATEMENT OF CLAIM: "Claim of the System Committee of the Brotherhood that Carrier violated and continues to violate our agreement when it refused and declined to bulletin and assign the position of Night Ticket Clerk, Danville, Ill. as vacancy on or about August 10, 1937, and that such position shall now be rated, bulletined and assigned under the provisions of Clerks' Agreement."

FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parts by the complainant party; and


That no hearing thereon has been had and under date of February 11, 1941, the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case.



Case dismissed.
