PARTIES TO DISPUTE:





STATEMENT OF CLAIM: "Claim of the General Committee of The Order of Railroad Telegraphers on the Pennsylvania Railroad that the carrier violated Part 1 of the Telegraphers' Agreement when it arbitrarily assigned to the agency at Downingtown, Pennsylvania, an employe not subject to, and who had never been subject to, said Agreement; that this party be removed, a new assignment properly made from amoi:g those employes carried on the agents' seniority roster, and appropriate reimbursement in salary made to the employe eventually assigned as agent at Downingtown."


FINDINGS: The Third Division of the Adjustment Board finds:

That this dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party; and


That no hearing thereon has been had, and under date of February 10, 1941, the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case.




Case dismissed.
