STATEMENT OF CLAIM: "Claim of the General Committee of The Older of Railroad Telegraphers on Pennsylvania Railroad, that the carrier violated the terms of Part 2 of the Telegraphers' Agreement on the Columbus Division by requiring the agent at Milford Centre, Ohio, covered by Part 1 of the Agreement to perform extra work as block-operator-leverman at Milford Centre covered by Part 2 of the Agreement, from 2:50 A. M. until 8:00 A. M., his starting time as Agent, on January 31, 1940, and that the agent shall be compensated at the rate of the position worked for having been called to perform this additional work."
That this dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party; and
That no hearing thereon has been had, and under date of February 10, 1941, the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case.
