PARTIES TO DISPUTE:





STATEMENT OF CLAIM: ` . for and in behalf of A. DeLuc who was formerly employed as a porter by the Illinois Central System, operating out of the District of Chicago, Illinois, for said carrier. Because the Management of the Illinois Central System did under date of May 1, 1940, discharge Mr. A. DeLuc from its service on charges unproved; which discharge was arbitrary, unjust and unreasonable and in abuse of the carrier's discretion. And further, for the record of ex-porter DeLuc to be cleared of this unproved charge and for ex-porter DeLuc to be paid for such time as he lost between the time he was discharged from said service up until the time he began to receive compensation from the Railroad Retirement Board."


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parts by the complainant party; and


That no hearing thereon has been had and under date of February 10, 1941 the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case.




Case dismissed.
