STATEMENT OF CLAIM: "Claim of the Joint Council Dining Car Employes for and in behalf of Waiters Claudius T. Bowman, Gail W. Porter and Ernest Litsey that because of unwarranted discipline y the Chicago, Milwaukee, St. Paul and Pacific Railroad Company resulting in their suspension from the service on October 27, 1939, for a period of 68 days, they be compensated for wage loss suffered therefrom according to the provisions of the existing agreement."


FINDINGS: The Third Division of the Adjustment Board finds:

That this dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party; and


That no hearing thereon has been held, and under date of May 15, 1941, the parties addressed a formal communication to the Secretary of the Third Division withdrawing this case.




Case dismissed.
