STATEMENT OF CLAIM: " . for and in behalf of W. G. Carroll, who is now and for a number of years past has been employed by the Minneapolis, St. Paul and Sault Ste. Marie Railroad Company as a sleeping car porter, operating out of Minneapolis, Minnesota. Because the Carrier above referred to did, under date of February 17, 1941, penalize porter W. G. Carroll by suspending him from active service of the Carrier for fifteen days on charges unproved. And further, because in so disciplining porter Carroll, the Carrier acted unfairly, arbitrarily and in abuse of its discretion. And further, for porter Carroll to have his record cleared of the charges and to be paid for the fifteen days wages lost because of such suspension in this matter."


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party;


That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; and


That hearing thereon has been held and concluded. The petitioner under date of July 31, 1941, and the respondent under date of August 5, 1941, respectively, advised the Secretary of the Third Division of their desire to withdraw this case from further consideration by the Division, which request is hereby granted.




Case dismissed.
