STATEMENT OF CLAIM: "Claim of the Terminal Board of Adjustment, Brotherhood of Railway and Steamship Clerks, Freight Handlers, Express and Station Employes that:
1. Robert Johnson be paid the difference between the pro rata rate and the time and a half rate for all Sundays or seventh day and for all holidays, and
2. That he also be paid the difference between the pro rata rate and the punitive rate for all time worked in excess of eight hours on any and all days as provided for in the rules of the current agreement, the same to be retroactive to September 3, 1937."
That the dispute was certified to the Third Division of the Adjustment Board ex parts by the complainant party; and
That no hearing thereon has been held and under date of July 25, 1941, the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case.
