PARTIES TO DISPUTE:

BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES




STATEMENT OF CLAIM: "Claim of the System Committee of the Brotherhood of Railway and Steamship Clerks, Freight Handlers, Express and Station Employes that the carrier shall now be required to establish regular assigned roster `B' positions at Salamanca, New York by using the man hours of Roster 'B' employes in accordance with Rule 25, paragraph 3, of the Clerks' Agreement and that employes suffering wage losses as a result of the carrier's refusal to establish regularly assigned roster `B' positions in accordance with Rule 25, shall be reimbursed for any and all wage loss sustained retroactive to May 20, 1940."


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parts by complainant party; and


That hearing thereon has been held but not concluded, and under date of September 4, 1941, the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case.




Case dismissed.
