STATEMENT OF CLAIM: "Claim of the System Committee of the Brotherhood that Fred Canastra, Trackman at Delanson, New York, be paid the difference between what he received at the straight time rate of 48 cents an hour and what he should have received at the rate of time and one-half; namely, 72 cents an hour, for eight and one-half hours' work performed on February 20, 1940."


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party; and


That hearing thereon has been held but not concluded. Under date of October 2, 1941, the parties jointly addressed a formal communication to the Secretary of the Third Division requesting that the claim be dismissed, which request is hereby granted.




Case dismissed.
