STATEMENT OF CLAIM:
"Claim of the General Committee of the
Brotherhood of Railway and Steamship Clerks, Freight Handlers, Express
and Station Employes on the Missouri Pacific Railroad Company that the
Carrier violated the clerks' Agreement,
1. On January 13th and 14th, 1941, Clerk, J. P. Murphy, occupant
of position of Bill Clerk at 23d Street Office, St. Louis, Mo. rate
$5.29 per day, assigned hours 6:00 A. M. to 2:00 P. M., completed
his eight hour tour of service and was doubled and worked on the
Rate Clerk position at 23d Street Office, St. Louis, Mo., St. Louis
Terminals, 4:00 P. M. to 12:00 Midnight, for which additional or
overtime service Clerk J. P. Murphy was paid $6.79 per day, the
pro rata rate of the Rate Clerk Position.
2. That Clerk, J. P. Murphy be compensated in the amount of difference due him, that is, $1.15 for each of the two days, or a
total of $2.30."
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the complainant party; and
That no hearing thereon has been held and under date of October 9,
1941 the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case.
AWARD
Case dismissed.
