STATEMENT OF CLAIM: "Claim of the System Committee of the Brotherhood that:


"(a) The carrier is violating the Clerks' Agreement at San Antonio, Texas, by using a trucker to perform the Janitor's regular assigned duties on Sundays and holidays, and denying the Janitor the right to perform and be paid for the work constituting his position. Also


"(b) Claim that the Janitor be compensated for all losses sustained because of the agreement violation."


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board jointly by the parties;


That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; and


That hearing thereon has been held and concluded. Under date of October 22, 1941, the parties jointly advised the Secretary of the Third Division of their desire to withdraw the case from further consideration by the Division, which request is hereby granted.


AWARD Case dismissed.
