BROTHERHOOD OF RAILROAD SIGNALMEN OF AMERICA



STATEMENT OF CLAIM: "(a) Request of 1. E. Bosworth and G. E. Kurtz, Pittsburgh Division signalmen, for compensation and adjustment in pay on the basis of one minimum day from 8:00 A. M. to 4:30 P. M., at the rate of 872 per hour on December 16, 17 and 18, 1937, and at the rate of time and one-half from 11:00 P. M. to 7:00 A. M., at the rate of 89¢ per hour on the nights of December 16, 17 and 18, 1937.


"(b) Request of W. W. Keyser, Pittsburgh Division signalman, for compensation and adjustment in pay on the basis of one minimum day from 7:00 A. M. to 3:30 P. M., at the rate of 870 per hour on December 16, 17 and 18, 1937, and at the rate of time and one-half from 11 :00 P. M. to 7:00 A. M., at the rate of 93¢ per hour on the nights of December 16, 17 and 18, 1937. "


FINDINGS: The Third Division of the Adjustment Board finds:

That this dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party; and


That no hearing thereon has been held, and under date of November 8, 1941, the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case.




Case dismissed.
