BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES




STATEMENT OF CLAIM: "Claim of the System Committee of the Brotherhood that, in conjunction with settlement made effective September 1, 1940, of a dispute for which the cause for action commenced July 16, 1939, monetary adjustment be made to employes involved retroactive to said date of cause for action, namely, July 16th, 1939, to September 1, 1940, the date on which settlement of the dispute was made effective by the Company, such adjustment to be on the basis of time and one-half rate for eight hours for each and every Sunday worked from July 16, 1939, to September 1, 1940, less compensation already paid.


"There is in evidence an Agreement between the parties bearing effective date of August 16, 1935."


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parts by the complainant party;


That no hearing thereon has been had and under date of December 16, 1941 the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case.


AWARD Case dismissed.
