PARTIES TO DISPUTE:

BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES




STATEMENT OF CLAIM: "Claim of the System Committee of the Brotherhood of Railway and Steamship Clerks, Freight Handlers, Express and Station Employes, that the carrier violated the agreement extant between the respective parties when; (a) it failed and refused to arrange for vacation for group one and two employes employed at its San Antonio, Texas, station during the year 1940, and (b) that the carrier shall be required, under the term:; of the agreement, to arrange for and grant vacations to its group one and two employes, as provided in said agreement."


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parts by complainant party;


That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; and


That hearing thereon has been held and concluded. Under date of December 22, 1941 the parties jointly advised the Secretary of the Third Division of their desire to withdraw the case from further consideration by the Division, which request is hereby granted.




Case dismissed.
