PARTIES TO DISPUTE:

BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES






STATEMENT OF CLAIM: "Claim of the System Committee of the Brotherhood of Railway and Steamship Clerks, Freight Handlers, Express and Station Employes, that the carrier violated the Clerks' Agreement:


(1) When, effective July 1934, Miss Rhema E. Aderholdt, Stenographer, Atlanta Freight Office, Atlanta, Ga., was arbitrarily transferred to position of Expense Bill Clerk, a higher rated position, performed, and is still performing the duties incident to this position but was then, and has since been, denied the rate applicable to the position to which arbitrarily assigned.


(2) That said Miss Rhema E. Aderholdt shall now be compensated for all wage loss suffered by reason of this violation retroactive to July 1934 and paid the difference represented in salary she has received $117.00 per month (plus $10.20 per month applied to all positions effective August 1, 1937), and salary she properly should have received, $13'0.00 per month (plus $10.20 per month increase applied to all positions effective August 1, 1937) this difference being $18.00 per month."

FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parts by complainant party;


That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; and


That hearing thereon has been held and concluded. Under date of January 8, 1942, the parties jointly addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this dispute, which request is hereby granted.



Case dismissed.
