PARTIES TO DISPUTE:

BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES






STATEMENT OF CLAIM: "Claim of the System Committee of the Brotherhood of Railway and Steamship Clerks, Freight Handlers, Express and Station Employes, that the Carrier violated the Clerks' Agreement:


(1) When, on January 25, 1940, a position as Seal Clerk was established, without bulletin covering same, at an arbitrary rate of $143.17 per month;


(2) That this position should have been rated at $180.17 per month, and;


(3) That employe K. C. Blackmarr shall now be compensated for the difference between $143.17 per month and $180.17 per month, or $37.00 per month, from January 25, 1940, until April 1, 1941, when duties of position were confined to those ordinarily and regularly performed by Seal Clerks."


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party;


That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; and


That hearing thereon has been held but not concluded. Under date of January 16, 1942, the Petitioner addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this dispute, which request is hereby granted.




Case dismissed.
