PARTIES TO DISPUTE:

BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES






STATEMENT OF CLAIM: "Claim of the System Committee of the Brotherhood of Railway and Steamship Clerks, Freight Handlers, Express and Station Employes, that:


(1) Position of Tag Clerk, Industry Yard, Atlanta, Ga., present rate $146.17 per month shall now be reclassified as Agency-Clerk and be rated at $169.17 per month, and


(2) That employe J. D. Huff shall now be paid the difference between present salary of $146.17 per month and proper rate of $169.17 per month retroactive to February 4, 1941, the original date of presentation of this claim."


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party;


That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; and


That hearing thereon has been held but not concluded. Under date of January 16, 1942, the Petitioner addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this dispute, which request is hereby granted.




Case dismissed.
