STATEMENT OF CLAIM: "Claim of the System Committee of the Brotherhood that:


(a) The carrier violated the Clerks' Agreement by refusing to make effective November 1, 1940, the annual assignments and rates of pay as shown for the positions listed below:

Cashier Frt. Station Weslaco 306 7.34

(b) Claim that the carrier further violated the Clerks' Agreement on

June 2, 1941, when, after reducing the annual assignments from 365 days to 306 days, it refused to adjust the rates of pay 'so that the earnings will be the same as received for 365 days.' Also


(c) Claim that the rates of pay and annual assignments as shown above be made effective November 1, 1940. And


(d) Claim that the occupants of the positions be paid at the rate of time and one-half for each Sunday and holiday from November 1, 1940, until June 2, 1941, the date the carrier reduced the assignments from 365 days annually to 306 days annually. Also


(e) Claim that all employes involved in or affected by the agreement violations be compensated for all losses sustained."


FINDINGS: The Third Division of the Adjustment Board finds:

That this dispute was certified to the Third Division of the Adjustment Board ex parts by complainant party; and

That no bearing thereon has been held, and under date of January 28, 1942, the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case.



Case dismissed.
