STATEMENT OF CLAIM: ` . for and in behalf of Mr. L. B. Sykes who was formerly employed by The Pullman Company as a porter operating out of the Pennsylvania Terminal District. Because The Pullman Company did, under date of May 17, 1941, discharge Mr. L. B. Sykes from his position as a porter in The Pennsylvania Terminal District of New York City, which discharge was un ust, unreasonable, in abuse of the Company's discretion and based upon urges unproved. And further for Mr. L. B. Sykes to be returned to his former position as a porter in the Pennsylvania Terminal District of New York City and to be reimbursed for all time lost by virtue of being discharged."
FINDINGS: The Third Division of the Adjustment Board, after giving the parties to this dispute due notice of hearing thereon, and upon the whole record and all the evidence, finds and holds:
That the carrier and the employes involved in this dispute are respectively carrier and employes within the meaning of the Railway Labor Act, as approved June 21, 1934;
That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; and
That hearing thereon has been held and concluded. Under date of February 7 1942, the employes and the carrier jointly advised the Secretary of the Third Division of their desire to withdraw it from further consideration by the Division, which request is hereby granted.
