PARTIES TO DISPUTE:





STATEMENT OF CLAIM: . . for and in behalf of R. W. Gray who was formerly employed as a porter by The Pullman Company operating out of the District of Little Rock, Arkansas. Because The Pullman Company did, under date of May 12, 1941, discharge porter Gray from his position as a porter in said district on charges unproved and which discharge was unjust, unreasonable and in abuse of the Company's discretion.


And further, for the restoration of porter R. W. Gray to his former position as a poter in the Little Rock, Arkansas District with his seniority unimpaired and with pay for all time lost by virtue of having been discharged.


FINDINGS: The Third Division of the Adjustment Board, after giving the parties to this dispute due notice of hearing thereon, and upon the whole record and all the evidence, finds and holds:


That the carrier and the employe involved in this dispute are respectively carrier and employe within the meaning of the Railway Labor Act, as approved June 21, 1934;


That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; and


That hearing thereon has been held and concluded. Under date of March 9, 1942, the employes and the carrier jointly advised the Secretary of the Third Division of their desirb to withdraw it from further consideration by the Division, which request is hereby granted.


AWARD Claim dismissed.
