PARTIES TO DISPUTE:

BROTHERHOOD OF MAINTENANCE OF WAY EMPLOYES



STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood that:


(1) The Carrier violated the provisions of Article II, Rules 3, 9 and 10 of the current agreement between the parties, in declining to permit Teddy C. Crawford, B. & B. Helper, to place himself in line with his seniority when displaced by a senior employe on April 4, 1940.


(2) That Teddy C. Crawford be paid for time lost from April 4, 1940 to May 7, 1940, both dates inclusive, as a result of the Carrier failing to advise him where he could place himself in line with his seniority.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parte by the complainant party; and


That no hearing thereon has been held, and under date of March 27, 1942, the complainant party addressed a formal communication to the Secretary of the Third Division requesting the withdrawal of this case, which request is hereby granted.




Case dismissed.
