STATEMENT OF CLAIM: Claim of Felix J. Duplessis, Signal Maintainer, for 6vs hours' pay at the rate of time and one-half his regular rate of 87 cents per hour account not being called on August 3, 1941, to perform emergency service in connection with damage to the interlocking plant at 79th Street Junction, Chicago, Illinois.

FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board jointly by the parties;


That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; and


That hearing thereon was waived. Under date of March 31, 1942, the parties jointly advised the Secretary of the Third Division of their desire to withdraw the case from further consideration by the Division, which request is hereby granted.



Case dismissed.
