STATEMENT OF CLAIM: Claim of Employes that:

(1) The carrier violated and continues to violate the agreement extant between the respective parties when it failed and refused to increase the monthly rate of pay in an amount equivalent to the number of hours comprehended by the monthly rate multiplied by Ten Cents (10¢);


(2) That all employes affected shall be reimbursed retroactively to December 1, 1941, for the difference between what they were and are being paid and what they should have received under the terms of the agreement; and


(3) That the monthly rates of pay shall be established on the basis of adding to the rates in effect December 1, 1941, an amount equivalent to the number of hours comprehended by the said monthly rate multiplied by Ten Cents (100).


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parts by the complainant party; and


That no hearing thereon has been held, and under date of April 4, 1942, the parties jointly addressed a formal communication to the Secretary of the Third Division requesting the withdrawal of this case, which request is hereby granted.




Case dismissed.
