BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES MISSOURI PACIFIC RAILROAD COMPANY
STATEMENT OF CLAIM: Claim of the General Committee of the Brotherhood of Railway and Steamship Clerks, Freight Handlers, Express and Station Employes on the Missouri Pacific Railroad, that the Carrier violated the Clerks' Agreement:
1. When on October 31, 1941, per Superintendent's Bulletin No. 49 dated October 31st, 1941, copy attached and designated as Exhibit "A"it advertised the clerical position of revising clerk at Burling, Ark., (Camp Chaffee), at a rate of $5.54 per day, which rate is forty-five cents (45¢) below the minimum rate of. $5.99 per day for positions of similar kind or class on the seniority district where the position was created, and failed and refused to apply the correct rate.
2. That the occupant or occupants of the position here involved be paid the amount of forty-five cents (45¢) per day difference in the wage agreement rate of $5.99 per day and $5.54 per day retroactive to and including the date the position was established and that the amount of increase awarded to other clerical positions through the provisions of the Mediation Wage Agreement signed at Chicago, III. on December 15th, 1941, effective September 1st, 1941 and December 1st, 1941 be applied to the rate of the position here involved and the occupant or occupants thereof be compensated accordingly, and since the position was bulletined at an improper rate that it be rebulletined to the clerical employes, class one, stations and yards seniority district and roster of the Southern Kansas-Central Division.
The dispute was certified to the Third Division of the Adjustment Board ex parts by complainant party; and
That no hearing thereon has been held and under date of April 30, 1942, the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case.
