PARTIES TO DISPUTE:

BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES




STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood that:


(1) The assignment of clerical work, hereinafter described in the Tulsa Station and Yard Seniority District to employes not covered by the Clerks' Agreement (Yard Master, Assistant Yardmaster and General Agent) is a violation of Articles 1, 2, 3, 11, and 12 and Principle 7, of the agreement dated effective June 14, 1921, and,


(2) That said work shall be classified, rated, bulletined, and assigned in accordance with the rules of the said agreement, and,


(3) That employes involved in or affected by said violations of rules be compensated in full for any monetary loss resulting from carrier's actions retroactive to September 19, 1937, date of complaint.


FINDINGS: The Third Division of the Adjustment Board finds that:

The dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party; and


That no hearing thereon has been held and under date of May 7, 1942, the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case.




Case dismissed.
