PARTIES TO DISPUTE:





STATEMENT OF CLAIM: "Claim of the General Committee of The Order of Railroad Telegraphers on Chicago, Burlington & Quincy Railroad, that the Carrier violated the Telegraphers' Agreement by declaring abolished the positions of the 2nd and 3rd Wire Chief at Sheridan and the 2nd Wire Chief at Casper, Wyoming, and the 3rd Wire Chief at Wymore, Nebraska, between certain dates as outlined in Employes' Statement of Facts, since incorporated into Telegraphers' Agreement of September 1, 1927, during which the Carrier transferred the duties of the positions to train dispatchers not under the TelePrauhers' Agreement; and that employes covered by the Telegraphers' Agreement who were adversely affected by these improper acts of the Carrier shall be reimbursed for all monetary losses suffered thereby."


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parte by the complainant party; and


That no hearing thereon has been held and under date of May 13, 1942, the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case.




Case dismissed.
