STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood that Section Foreman George Spraker, located at Silt, Colorado, who was dismissed from the service March 18, 1941, be reinstated to service with all rights restored, and that he be paid for all time lost from March 18, 1941, until restored to the service as Section Foreman.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party;


That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; and


That hearing thereon has been held and concluded. Under dates of May 26, 1942 and June 1, 1942, the parties addressed formal communications to the Secretary of the Third Division requesting withdrawal of this dispute, which request is hereby granted.




Case dismissed.
