PARTIES TO DISPUTE:





STATEMENT OF CLAIM: Claim of the Joint Council, Dining Car Employes, Local 370, of the Hotel & Restaurant Employes International Alliance on the property of the Pennsylvania Railroad Company, for and in behalf of Thomas Daniel and other employes similarly situated that-


1. Thomas Daniel and others be compensated for work performed as Dining Car Stewards on June 26th, 1941, and for subsequent service since that date.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party;


That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; and


That hearing thereon has been held and concluded. Under date of June 26, 1942, the parties jointly addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this dispute, which request is hereby granted.




Case dismissed.
