STATEMENT OF CLAIM: Claim of the General Committee of The Order of Railroad Telegraphers on Chicago, Burlington and Quincy Railroad, that (a) when the Carrier, without conference and agreement, on and since April 24, 1938, removed from employes covered by the current Telegraphers' Agreement at Lewistown, Illinois, the duties of loading and unloading mail, baggage and express between the station building and Train No. 51, due to arrive at Lewistown outside the assigned hours of said station employes, and assigned said duties to the members of the train crew of Train No. 51, work which these men we represent had previously exclusively performed at Lewistown was improperly transferred to employes not covered by the Telegraphers' Agreement; that (b) the work here involved be restored to station employes under the agreement; and that (c) the agent at this station is entitled to and shall be paid a call for each occasion on which these employes not covered by the Telegraphers' Agreement have performed the aforementioned work since April 24, 1938.
That the dispute was certified to the Third Division of the Adjustment Board ex parts by the complainant party; and
That no hearing thereon has been held and under date of June 29, 1942 the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case.
