PARTIES TO DISPUTE:

BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES


HOUSTON BELT & TERMINAL RAILWAY COMPANY

STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood that:


(a) The Carrier is violating the Clerks' Agreement by requiring Record Clerks to perform work of the Interchange Clerk, Also

(b) Claim that the First Record Clerk be paid an additional 84¢ per day, and the Third Record Clerk an additional 88¢ per day, retro. active to the date the interchange work was assigned to their positions. Also

(c) Claim that the Interchange Clerk be paid eight (8) hours at the rate of time and one-half for each Sunday and holiday retroactive to May 16, 1941.

FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parts by complainant party;


That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; and


That hearing thereon has been held and concluded. Under date of August 20, 1942, the parties jointly addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this dispute, which request is hereby granted.




Case dismissed.
