STATEMENT OF CLAIM:
Claim of the System Committee of the Brotherhood that:
(a) The Carrier is violating the Clerks' Agreement, effective November 16, 1940, by refusing to reduce the annual assignment of the
Chief Clerk to the Auditor from 365 days to 806 days with the same
monthly rate of pay. Also
(b) Claim that the Chief Clerk to the Auditor be paid an additional
day's pay at the rate of time and one-half for each Sunday and holiday
from November 16, 1940, until correct annual assignment and rate of
pay is made effective.
FINDINGS:
The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by complainant party;
That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; and
That hearing thereon has been held and concluded. Under date of August
20, 1942, the parties jointly addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this dispute, which request is hereby granted.
AWARD
Case dismissed.
