PARTIES TO DISPUTE:

BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS,
FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES



STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood:

1. That the Carrier violated the Clerks' Agreement when it abolished the positions of Line Desk Clerk and Record Clerk at Big Springs, Texas on October 27, 1940 and assigned part of the work and duties of these positions and other work under the scope of the Clerks' Agreement to employes not covered by said agreement.


2. That the Carrier violated the Clerks' Agreement when it instructed the caller to perform three (3) hours and fifty (50) minutes clerical work per day.


3. That the Carrier violated the Clerks' Agreement when it required the occupant of position of Bill Clerk in Local Freight Office, rate $4.94 per day to perform duties of a yard clerk, rate $5.07 per day.


4. That all employes under the scope of the Clerks' Agreement be compensated for any monetary loss they may have sustained by reason of this violation retroactive to October 27, 1940.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party; and

That no hearing thereon has been held, and under date of July 1 1942 the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case.



Case dismissed.
