PARTIES TO DISPUTE:





STATEMENT OF CLAIM: Claim of the General Committee of The Order of Railroad Telegraphers on the Southern Pacific Company, Pacific Lines, that Telegrapher H. A. McCoy, Jr., be compensated under the provisions of Rule 4 (b) of Telegraphers' Agreement for services performed in relieving regularly assigned Printer-clerk Betty Cain at Yuma, Tucson Division, November 22nd, 1939, to January 8th, 1940, inclusive.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment, Board ex parte by complainant party; and


That no hearing thereon has been held, and under date of September 3, 1942, the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case.




Case dismissed.
