STATEMENT OF CLAIM: (a) That J. Kirkpatrick be paid the difference in the assistant signalman's rate of pay and the rate of pay of a signalman for all services performed covering the periods January 31, 1940, to May 20, 1940, and July 2, 1940, to April 18, 1941.
(b) That J. Kirkpatrick's seniority date as a signalman shall be January 31, 1940.
That the dispute was certified to the Third Division of the Adjustment Board ex parts by complainant party;
That this Division of the Adjustment Board has jurisdictibn over the dispute involved herein; and
That hearing thereon has been held and concluded. Under date of August 27, 1942, the parties jointly addressed a formal communication to the Secretary of the Third Division requesting the withdrawal of this dispute, which request is hereby granted.
