STATEMENT OF CLAIM: Claim of the General Committee of The Order of Railroad Telegraphers, Atchison, Topeka & Santa Fe Railway Company, that A. A. Jerauld, agent, National City, California, shall be compensated on each date February 22, March 2 and 9,1941 (Sundays) when the carrier permitted and/or required an engine foreman at National City to sign bills of lading, taking same to San Diego, (a supervisory agency) where the waybills were prepared by the agent's ofce at that point.


FINDINGS. The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party; and


That no hearing thereon has been held, and under date of September 3, 1942, the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case.




Case dismissed.
