STATEMENT OF CLAIM: Claim of the General Committee of The Order of Railroad Telegraphers, Atchison, Topeka & Santa Fe Railway Company that (a) the carrier violated the provisions of the Telegraphers' Agreement when on April 30 and May 9, 1941, it required or permitted section foreman or section foremen at Leesburg, New Mexico, to copy train line-ups, and (b) in consequence thereof the senior idle extra board telegrapher, on each date, is entitled to and shall be allowed one day's pay at the minimum telegraph rate.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party; and


That no hearing thereon bas been held, and under date of September 3, 1942, the complainant party addressed a formal communication to the Secretary of the 'third Division withdrawing this case.




Case dismissed.
