STATEMENT OF CLAIM: Claim of the General Committee of The Order of Railroad Telegraphers, Atchison, Topeka & Santa Fe Railway Company that (a) the carrier violated and continues to violate the provisions of the Telegraphers' Agreement when (1) it requires that train orders addressed to train crews at Yampai be transmitted to telegraphers at Hackberry, thence carried to Yampai by other train crews for delivery, and (2) it requires and/or permits persons at Yampai, not covered by the Telegraphers' Agreement, to make use of a telephone thereat in connection with train movements; (b) elegraph positions, sufficient to perform such duties, be established; and, (c) pending such estabishment, and retroactively, the senior extra available telegraphers be allowed one day's pay for each eight hours in each twenty-four (24) hour period that said train orders are carried from Hackberry to Yampai and/or the telephone at Yampai is used by persons not covered by the Telegraphers' Agreement in connection with movements of trains.
That the dispute was certified to the Third Division of the Adjustment Board ex parts by complainant party; and
That no hearing thereon has been held, and under date of September 3, 1942, the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case.
