STATEMENT OF CLAIM: Claim of the General Committee of The Order of Railroad Telegraphers, Atchison, Topeka & Santa Fe Railway Company that (a) the carrier violted the provisions of the Telegraphers' Agreement on each occasion, January 24 and 25, 1941 and subsequent dates, when it required that train orders addressed to C. & E. Nos. 50 and 52 at Morse, Oklahoma, be transmitted to a telegrapher at Shattuck, Oklahoma, thence carried to destination and delivered to addressees by conductors in charge of trains Nos. 49 and 51, and (b) in consequence thereof the senior idle extra board telegrapher, on each date, is entitled to and shall be allowed one day's pay at the Morse rate.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parts by complainant party; and


That no hearing thereon has been held, and under date of September 3, 1942, the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case.




Case dismissed.
