STATEMENT OF CLAIM: Claim of the General Committee of The Order of Railroad Telegraphers, Atchison, Topeka & Santa Fe Railway Company, that (a) the position of agent-telegrapher at Tecumseh, Kansas, covered by the Telegraphers' Agreement and listed in the wage scale (p. 30) at an agreedto rate of 60¢ per hour, not having been abolished in fact, shall be restored to the Telegraphers' Agreement, and (b) all employes affected by the improper closing of said agency shall be returned to positions previously occupied by them and reimbursed in the amount of any and all wage losses sustained and expenses incurred.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party; and


That no hearing thereon has been held, and under date of September 3, 1942, the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case.




Case dismissed.
