PARTIES TO DISPUTE:

BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES




STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood of Railway and Steamship Clerks, Freight Handlers, Express and Station Employes that Carrier violated the Clerks' wage agreement and the provisions and intent of Rule 37 of current schedule when, effective May 16, 1941, it created position of Clerk-Typist at Sharpsville, Pa. and rated the position at $4.00 per day, and


That Carrier shall now be required by appropriate order of the Board to establish a rate of $4.35 per day on such position, effective May 16, 1941, plus the .SO0 per day under Mediation Agreement dated December 15, 1941, and


That employe Gabler and any other employes affected be reimbursed for any and all wage loss suffered by reason of this violation, retroactive to May 16, 1941.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parts by the complainant party; and


That no hearing thereon has been held, and under date of August 28, 1942, the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case.




Case dismissed.
