PARTIES TO DISPUTE:




STATEMENT OF CLAIM: Claim of the General Committee of The Order of Railroad Telegraphers, Atchison, Topeka & Santa Fe Railway Company, that the senior idle extra board telegrapher on each of the involved seniority districts is entitled to and shall be compensated one day's pay at the minimum hourly telegraph rate on each of the following occasions:


(a) August 8, 1940, when train orders addressed to Work Extra in charge of Conductor Rawn at Elvira were transmitted direct from train dispatcher to a telegrapher at San Diego, thence carried to Elvira for delivery by General Foreman Martens.


(b) August 9 and 10, 1940, when train orders addressed to Work Extra in charge of Conductor Rawn at Elvira were transmitted direct from dispatcher to a telegra her at Oceanside, thence carried to Elvira for delivery by General Foreman Martens, and


(c) December 2, 1940, when train order addressed to a Work Extra at Blanchard was transmitted direct from dispatcher to a telegrapher at Chapelle, thence carried to Blanchard for delivery by Signal Supervisor Hutton.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parts by complainant party;


That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; and


That hearing thereon has been held and concluded. Under date of September 9, 1942 the parties jointly addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this dispute, which request is hereby granted.




Case dismissed.
