STATEMENT OF CLAIM: Claim of the General Committee of The Order of Railroad Telegraphers, Atchison, Topeka & Santa Fe Railway Company, that (a) the carrier violated the provisions of the Telegraphers' Agreement when for eight hours each day June 27, 28 and 30, July 1, 2 and 3, 1941, it required and/or permitted Miss Haynie who was regularly assigned to a switchboard operator position at Amarillo, not covered by said Telegraphers' Agreement, to occupy a telegraph schedule position at Amarillo, and (b) in consequence thereof telegraph schedule employes, viz., F. G. Spann, H. W. Moore and T. R. Selders who were available for twelve (12) hours, twenty-four (24) hours, and twelve (12) hours overtime, respectively, over the six-day period, are entitled to and shall be paid accordingly.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to they Third Division of the Adjustment Board ex parte by complainant party;


That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; and


That hearing thereon has been held and concluded. Under date of September 9, 1942 the parties jointly addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this dispute, which request is hereby granted.




Case dismissed.
