PARTIES TO DISPUTE:



THE CHICAGO, ROCK ISLAND AND PACIFIC RAILWAY
COMPANY

STATEMENT OF CLAIM: Claim of the General Committee of the Order of Railroad Telegraphers, Chicago, Rock Island and Pacific Railway, that telegrapher R. Herbert was, as a result of discrimination by the Superintendent of Telegraph, denied, on twenty-five days in May, June and July, 1939, as detailed in the accompanying Statement of Facts, the right to work a regular position in "GO" General Telegraph Office, hicago, to which his seniority rights entitled him; and that he now be paid for these twenty-five days at $6.96 a day, the regular daily rate for the position involved.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party;


That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; and


That hearing thereon has been held and concluded. Under date of September 22, 1942, the parties jointly addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.




Case dismissed.
