STATEMENT OF CLAIM: Claim of the General Committee of .The Order of Railroad Telegraphers, Pennsylvania Railroad, that the duties of receiving and transmitting messages of record and reports of record is work covered by the Telegraphers' Agreement; that the car distributor at Terre Haute, whose position is not covered by said Agreement, is being improperly required or permitted to perform duties belonging to employes covered by said Agreement; that the Carrier shall hereafter have these duties of receiving and/or transmitting messages and reports of record handled by employes coming under the scope of the Telegraphers' Agreement, and that the oldest, idle extra telegrapher available and competent shall be paid one day's pay at the applicable rate for each day, since claim for this renumeration was made, that this work has been performed by an employe not covered by the Telegraphers' Agreement.
That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party; and
That no hearing thereon has been held, and under date of October 12, 1942 the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case, which request is hereby granted.
