STATEMENT OF CLAIM: Claim of the General Committee of The Order of Railroad Telegraphers, Chicago, Rock Island & Pacific Railway, that Telegrapher C. E. Cotner, Enid, Oklahoma, is entitled to a call because on March 2, 1941, train order No. 344 was sent from El Reno in care of the crew of Extra 1954, and the yard engine at Enid, for delivery to the crew of the switch engine at Enid to avoid payment of overtime to Telegrapher Cotner.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party; and


That no hearing thereon has been held, and under date of October 12, 1942 the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case, which request is hereby granted.




Case dismissed.
