STATEMENT OF CLAIM: Claim of the General Committee of The Order of Railroad Telegraphers, Chicago, Rock Island & Pacific Railway, that Telegrapher J. D. Foreman, Turon, Kansas, is entitled to a call because on March 18, 1941, while he was of duty, train order No. 218 was sent from Langdon in care of the crew of train No. 91 for delivery to train No. 2nd 92 at his station, to avoid payment of this overtime.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex paste by complainant party; and


That no hearing thereon has been held, and under date of October 12, 1942 the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case, which request is hereby granted.




Case dismissed.
