BROTHERHOOD OF MAINTENANCE OF WAY EMPLOYES



STATEMENT OF CLAIM: Claim of C. C. Tilson, water service mechanic, Cedar Rapids Division, working as water service repairman's helper on account of reduction in force, that he be paid the difference between the rate received as water service mechanic helper, and that applicable to a water service mechanic, for two hours devoted by employes in the Mechanical Department in making alteration to a pipe line in Cedar Rapids roundhouse.


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party;


That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; and


That hearing thereon has been held and concluded. Under dates of October 9, 1942 and October 16, 1942 the parties addressed formal communications to the Secretary of the Third Division requesting the withdrawal of this case, which request is hereby granted.




Case dismissed.
